BUTUAN CITY – An improved separation package with a total amount of 6.0 Million was granted by CTP Construction and Mining Corp (CTPCMC) management to eighty five (85) retrenched workers through the intervention and collaboration of NCMB and DOLE Caraga.  Finally, on September 19, 2018 the workers received their separation pay computed as 26 days/year of service.

Citing from the report of OIC Director Ma. Theresa M. Francisco, “This case stemmed from a complaint of KMU Caraga to the Office of the Secretary of Labor and Employment involving seven (7) mining and two (2) agriculture companies operating in Caraga Region where CTPCMC is one of the establishment involved.”

Leaders of KMU and representatives of the management participated during the initial conference called by Secretary Bello on July   20-22, 2017 at the OSEC Conference Hall, Intramuros, Manila.  Undersecretaries D. Say, J. Maglungsod and NCMB Administrator Shirley Pascual facilitated the conference together with this Office and DOLE Caraga Officials.   Series of conciliation proceedings were conducted to the parties at the regional level to effect amicable settlement. 

Initially, CTPCMC offered ½ month per year of service separation benefits based on the provision of authorized causes but out of 300 retrenched employees, there are 85 union members opted not to receive the offer of the management. Through continued conciliation and negotiation to the parties, finally management approved the 26 days per year of service as improved separation package to the remaining 85 members of CTP Construction Mining Corporation United Workers Union-NAFLU-KMU.

OIC Francisco added that Mr. Jacinto Tanduyan of KMU Caraga expressed his grateful appreciation to the Department of Labor and Employment and this Office for the determination and persistence in achieving a win-win solution to the labor dispute. 

Atty Odessa Bernardo of CTPCMC conveyed her thanks to Mr. Jacinto Tanduyan of CTPCMCUWU-NAFLU-KMU for the full cooperation as well as to DOLE & NCMB Caraga for the timely intervention and acting with extra effort in attaining mutual agreement to the parties.

CTP Construction and Mining Corporation located in Carrascal, Surigao Del Sur is engage in mining of nickel and ore with a total employment of more or less 400+ workers, represented by its President, Mr. Clarence T. Pimentel. The 2017 retrenchment program of CTPCMC caused by suspension of operation order of DENR for failing to implement social development projects and for environmental violations.
